
WHEREAS Utah Code § I 0-8-4 7 empowers municipal legislative bodies to prevent conditions hazardous to public safety, including the regulation and prohibition of fireworks and ignition sources in accordance with Utah Code §53-7-225; and
WHEREAS Utah Code § I 0-8-84 authorizes Moroni City to pass all resolutions and rules necessary to secure the safety, health, and general welfare of the municipality and its inhabitants; and
WHEREAS on June 25, 2026, Governor Cox has declared a state of emergency due to current fire conditions due to a high burn index and low moisture content in vegetation which combined with weather conditions creates a significant public risk; and
WHEREAS on June 25, 2026, Governor Cox for the State of Utah executive order suspended the Utah Division of State Forester statutory authority thus permitting the State Forester to ban all fireworks within all state municipalities effectively permitting a ban on all fireworks;
WHEREAS the Utah Division of State Forester has banned the detonation of all fireworks prepared and executed through a licensed firework show coordinator or the fireworks are strictly used within a muncipally designated area as jointly determined by the City Mayor and fire chief; and
WHEREAS the Moroni City Council finds it in the absolute best interest of the public health, safety, and welfare of its citizens to impose Fire Restrictions and to restrict the use of private fireworks within the municipal boundaries of Moroni City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MORONI CITY, SANPETE COUNTY, UTAH, AS FOLLOWS:
Section 1: Declaration of Emergency Stage 3 Restrictions. Pursuant to the authority granted by Utah Code §§ 10-8-47, I 0-8-84, and l 5A-5-202.5, the Moroni City Mayor and fire authority, in concurrence with the Moroni City Council, hereby declares a restriction on the use of any open fires and all private fireworks within Moroni City except for the professional show exhibition provided through a licensed firework show coordinator.
Section 2: Prohibited Activities. During the effectiveness of this resolution, it shall be unlawful for any person to carry out the following acts:
- Open Fires: Setting, building, maintaining, attending, or using open fires of any kind, including but not limited to agricultural, recreational, or industrial open burnings and campfires.
- Contained Open Fires: Utilizing stationary masonry or metal fireplaces, wood stoves, or outdoor fireplaces without an approved safety inspection and proper spark arrestor.
- Fireworks Restrictions: The personal use or detonation of private fireworks within the municipal boundaries of Moroni City.
- Ignition Sources: Cutting, welding, or grinding metal in areas of dry vegetation, or utilizing any other ignition source in hazardous environmental areas.
Section 3: Enforcement and Penalty. Every officer charged with enforcement of state and municipal laws within Moroni City, including the Fire Marshal and local law enforcement, is to advise individuals of the restriction on use of fireworks and open fires within City boundaries, and that any person who intentionally, knowingly, or recklessly violates this resolution resulting in a fire is recommended by the City to be subject to prosecution under applicable Utah state laws for creating an immediate hazard to public safety.
Section 4: Effective Date, Filing, and Expiration. This resolution shall take effect immediately upon its adoption. In compliance with Utah law, this final resolution shall be officially deposited in the City Recorder’s office, and a public notice shall be posted immediately. These emergency restrictions shall remain in effect until the local fire official certifies that the extreme fire danger has subsided and the City Council explicitly rescinds or downgrades this order by subsequent action
